Hyde and the 11-year-old were jointly charged with aggravated assault on a 14-year-old female minor, a student of a Belize Rural District address.


The 11-year-old?s sister, aged 14, (adopted) who was a friend of the virtual complainant, was charged with damage to property and abetment to commit aggravated assault.


None of the 14-year-olds appeared in court.


According to police, on Saturday, July 17, the 14-year-old minor visited the police station in the company of her mother, where they made a report of an assault.


The minor told police that whilst she was visiting a friend in the St. Martin de Porres area, a male person of dark complexion, whom she did not know, visited the house where she was and sat on a sofa chair beside her and started to touch her breast.


When she moved from where he was, he followed her and closed the door so she could not leave.


Her friend, the 14-year-old, then started to pull her blouse, causing it to tear, and then the friend tore her long blue jeans pants.


Her friend then held a knife to her neck so she could not move while the dark-skinned male person, later identified as Hyde, began fondling her breast and vagina, while the 11-year-old boy also fondled her breast and vagina.


Chief Magistrate Lord struck out the case against two of the defendants – the 11-year-old and Hyde, because the virtual complainant was unable to be located, despite police?s numerous attempts to find her.


This morning the trial was to begin, but at its commencement, the minor?s mother asked to speak. She asked the magistrate to please assist in the closure of the case because it has been affecting the minor, who is attending school.


Chief Magistrate Lord then decided not to dismiss the charges against the 14-year-old defendant who has failed to appear in court since May 28 of this year, despite police attempts to locate her. The case has been adjourned about 14 times.


Chief Magistrate Lord said that she had been charged with a serious crime and because she has failed to show up in court, he will charge her in ?sine-die,? which means a date will be set in the future for trial, if she is located.
