Palma, a 14-year-old minor, testified that he saw Wade in the police pickup truck that was in front of the van in which the deceased and the other eyewitness were travelling. He said Wade fired a warning shot while he was at the tailgate of the pickup truck with one foot in and one foot out. He also testified that he heard more shots being fired when the pickup truck travelled further down the road. Palma was standing on the roadside.

Pickart, who was in the back seat of the van, testified that from where he was sitting, he could not identify the person who fired the shot that killed Darnell McDonald. He said he heard the shot and saw McDonald fall afterwards.

Dr. Mario Estradabran, who did the post-mortem, testified that the bullet entered the left side of the deceased?s nostril and the damaged slug was taken out of the base of his brain.

Force Armourer Albert Ciego testified that the slug was damaged. Under cross-examination, he said that it could have been fired from a .38 pistol or a 9-millimetre pistol.

Wade is being represented by attorney Simeon Sampson, and the trial judge is Justice Adolph Lucas.

The trial began last week.
