Police found Fitzgibbon in the bedroom of the house with the minor
Tonight, Enfield Ervin Fitzgibbon, 23, a resident of Mahogany Heights, and Ryan Alvarez, 22, a resident of #3150 Supal Street, are on remand at the Hattieville Prison after being charged with aggravated assault of an indecent nature and carnal knowledge respectively.
According to police, on Tuesday, acting on information they received, they visited a home on South Creek, where they found Alvarez inside the home, and inside the bedroom, they found Fitzgibbon with a female minor, 13, a student, whose upper body only, was clothed.
Police immediately contacted the Social Service Department, who then took the minor to a hospital where a doctor certified that she was carnally known.
Police, after conducting interviews with the minor, learned that she had arrived at the house about 8:00 that morning, and had engaged in sex with Alvarez, hence the reason he is charged with carnal knowledge.
She further stated that although Fitzgibbon did not have sex with her, he did fondle her.
Alvarez and Fitzgibbon were unrepresented in court, and since carnal knowledge is an indictable offense, no plea was taken from Alvarez and neither was he offered bail.
Fitzgibbon, who pleaded not guilty to his charge, was also remanded after the prosecutor objected to bail, basing his arguments on the fact that his charge stemmed from the same incident, and if released, police feared that he would interfere with the minor.
The men are scheduled to return to court on March 20, 2013.
