Kaseke is applying for a ?case stated,? which can only take place at the Supreme Court. He is basing his ?case stated? solely to answer one question – whether Chief Magistrate Lord was fair in his decision of not accepting the new affidavit as evidence. He also said that the ruling is being prejudicial and unfair to the United States Government.


Kaseke said that his reasons for requesting a ?case stated? is not to challenge the Chief Magistrate?s decision, but rather to have the questions answered to avoid prejudice, and so that the hearing could proceed.


Dean Barrow, Leader of the Opposition and Pawpa?s attorney, said that the Sol Gen?s desperation is disappointing, because the application was completely ridiculous.


Kaseke disagreed and said that he has a right to request a ?case stated? if he is dissatisfied with the decision made, noting that there is a superior court to give a ruling, and that now is a better time than any to apply, being that they are at a stage of ?voire dire.?


Barrow maintained his point in court, and said that the law provides that Kaseke apply for an appeal, but only after the hearing is complete, and not now.


After listening to submissions from both defense and prosecution, Chief Magistrate Lord said that he is going to give his ruling on whether or not he is going to accept the request for ?case stated,? to the Supreme Court, on Monday, August 15, at 10:00 a.m.


On Tuesday, August 9, after the Chief Magistrate had made his ruling, Barrow said that without the second affidavit being tendered as evidence, the prosecution has no case and that Pawpa is home free. He added that he believes that the hearing for Pawpa, which is the only one being tried now, will be finished tomorrow, Friday.


Kaseke disagreed and said that he would still try to tender the second affidavit in the actual hearing.


There were a group of picketers both today and on Tuesday, holding placards in support of Pawpa. One read ?Stop sell di pupsie, fi save di shark!?
