Supreme Court Justice Courtney Abel this afternoon denied a request by Kolbe Foundation for an injunction against four of their ex-workers who have been named in a libel suit for a video documentary that had been posted online on Facebook, but which has since been removed.

A spokesperson of the Coalition expressed gratitude for the first-round victory they had in court today.

The defendants, Herman Blease, Sr., JP, Abdul Marin, Carla Casimiro and Carla Budna, will also have to answer to a libel claim for damages.

In a letter to the defendants earlier this month, Courtenay Coye LLP, which represents Kolbe, had said they would pursue $75,000 in damages and costs, including $25,000 in attorney’s fees.

Rather than grant an injunction against the publication of the documentary, the judge got a consent agreement from the group that the video will not be republished on Facebook while the case is before the court.

When the group was first threatened with a lawsuit, they refused to remove the video, claiming that they can prove whatever was said in the mini-documentary.

The judge suggested that it is best that the video not be published anymore.

Apart from addressing the request for an injunction, Justice Abel also set timelines for documents to be filed with the court.

The ex-workers of Kolbe appeared unrepresented.
