They had brought more than the necessary amount of cement that was needed.


I found a buyer for six sacks. I agree that I went into the house. The door was closed, said Kelly.


Michael Garbutt, a mechanic of St. Thomas Street, reported to police that on August 18, 2004, his house at #17 West Lake Park, on the Western Highway, was broken into and six sacks of Maya brand cement, valued $78.00, were stolen.


Garbutt reported to police that entry to his house was gained through the back door on the western side of the building.


The police, acting on information, arrested Denton Kelly and escorted him to the Hattieville Police Station.


The five sacks of cement were recovered and Kelly was subsequently charged with committing the crime of burglary.


Chief Magistrate Lord explained to Kelly that under Section 148 of the Criminal Code, he could be sentenced to a minimum of five years, but since he has no other previous conviction, he was sentencing him to eighteen months in prison.
